Upacut Boxing & Fitness ACN 48 698 012 654 (“we”, “us”, “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, store, disclose, and protect personal information that we obtain through our mobile application (“the App”), our website, and our gym premises.This Policy is governed by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). By using the App or becoming a member, you consent to the collection and handling of your personal information as described in this Policy.
‍2. Information We CollectWe collect the following categories of personal information:
‍2.1 Account InformationFull nameEmail addressPhone numberDate of birthEmergency contact name and phone numberProfile photograph (optional, if you choose to upload one)
‍2.2 Payment InformationWhen you purchase a membership, class pack, or casual access, we collect payment details necessary to process the transaction, including credit/debit card details or direct debit bank account details. Card details are processed directly by our payment processor (see clause 5) and are not stored on our servers.
‍2.3 Health & Fitness InformationPre-exercise health questionnaire responses, including disclosed medical conditions, injuries, medications, and pregnancy status;Class attendance records and booking history;Training progress data you choose to record in the App (such as workouts logged, training streaks, and goals);Any medical certificates or clearances you provide.Health information is sensitive information under the Privacy Act and is afforded a higher level of protection. We only collect health information that is reasonably necessary to provide you with safe access to our services.
‍2.4 Location InformationWith your permission, the App may collect device location data to help you find our gym, check in to classes when you arrive, and improve the relevance of class recommendations. You can disable location access at any time in your device settings without affecting your ability to use other features of the App.
‍2.5 Technical InformationDevice identifiers and operating system information;App usage data (features accessed, screens viewed, session duration);IP address and approximate location derived from it;Push notification tokens (if you opt in to notifications).

How We Collect InformationWe collect personal information directly from you when you:Create an account in the App or sign up at the gym;Complete a pre-exercise questionnaire or membership application;Book a class, purchase a pass, or pay a membership fee;Contact us by email, phone, or in person;Interact with the App or our website.In limited circumstances we may receive information about you from third parties, such as a referring family member, a medical practitioner providing clearance on your behalf, or a personal trainer engaged by you.

How We Use Your InformationWe use your personal information to:Provide you with access to the gym, classes, and App features;Process payments, manage memberships, and issue receipts and invoices;Assess your fitness to participate in physical exercise and tailor activities to your safety needs;Communicate with you about bookings, class changes, account matters, and operational updates;Send you marketing communications about our services, classes, events, and promotions (where you have consented or where permitted by law) — you can opt out at any time;Improve the App and our services, including analysing usage patterns and resolving technical issues;Comply with our legal obligations and respond to lawful requests from regulators or law enforcement;Investigate and respond to incidents, complaints, or breaches of our membership terms.
‍5. Disclosure to Third PartiesWe do not sell your personal information. We disclose personal information only to the following categories of recipients, and only to the extent reasonably necessary:
‍5.1 Service ProvidersOur booking and gym management platform (which stores member profiles, bookings, attendance, and payment metadata);Payment processors (such as Stripe and our direct debit provider), who process card and bank transactions on our behalf;Email and SMS communication providers used to send transactional and marketing messages;Analytics providers (such as Google Analytics and similar tools) which help us understand App usage. Where possible, this data is aggregated or pseudonymised.
‍5.2 Other DisclosuresProfessional advisors (such as lawyers and accountants) where reasonably necessary;Government bodies, regulators, or law enforcement where required by law;Medical or emergency services in the event of an incident or emergency at the gym;A purchaser or successor of our business, in connection with a sale or restructure, subject to appropriate confidentiality protections.
‍5.3 Overseas DisclosureSome of our service providers (in particular cloud hosting, analytics, and payment processors) may store or process your information outside Australia, including in the United States and the European Union. We take reasonable steps to ensure that overseas recipients handle your information in a manner consistent with the Australian Privacy Principles.
‍6. Data SecurityWe take reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification, and disclosure. These steps include encryption of data in transit, restricted access controls, secure password storage, and regular review of our systems.However, no method of transmission or storage is completely secure. If you suspect a security incident affecting your account, please contact us immediately.
‍7. Data RetentionWe retain your personal information for as long as your membership is active and for a reasonable period afterwards to meet our legal, accounting, and operational obligations. Health information is generally retained for seven (7) years after your last visit, in line with healthcare record standards. We will securely destroy or de-identify personal information when it is no longer required.

Your RightsUnder the Privacy Act, you have the right to:Request access to the personal information we hold about you;Request correction of information that is inaccurate, out of date, incomplete, irrelevant, or misleading;Withdraw consent to marketing communications at any time by using the unsubscribe link or contacting us;Request deletion of your account and associated personal information, subject to our legal retention obligations;Lodge a complaint about how we handle your personal information (see clause 10).To exercise any of these rights, contact us using the details in clause 11. We will respond within a reasonable time, generally within thirty (30) days.
‍9. ChildrenThe App and our services are intended for users aged 18 and over, or aged 14 to 17 with parental or guardian consent. We do not knowingly collect personal information from children under 14. If you believe we have collected such information, please contact us so we can delete it.10. ComplaintsIf you believe we have breached your privacy or mishandled your personal information, please contact us using the details in clause 11.
